Terms & Conditions

These Terms and Conditions apply to all purchases made from Sunshine Pools, a brand operated by MadFun Ltd ("we", "us", "our"). By placing an order, you agree to be bound by these terms.

1. Company Information

Sunshine Pools is a trading name of MadFun Ltd. We are registered in England and Wales under company regisration number 05987974. Our registered office is c/o Strivex Ltd, Beacon House, Ibstone Road, Stokenchurch, High Wycombe, Buckinghamshire, HP14 3FE and we're based at Unit 7D, Shawlands Court, Newchapel Road, Lingfield, Surrey, RH7 6BL.

All transactions are subject to UK law.

2. Formation of Contract

All products and prices displayed on our website constitute an "invitation to treat" and do not represent a binding offer by us. Your order represents an offer to purchase. A legally binding contract between you and MadFun Ltd is only formed when we have processed your order, accepted your payment, and dispatched the goods to you. We reserve the right to decline any order for any reason, including pricing errors or stock unavailability, prior to dispatch.

3. Product Information

We take every care to ensure that product descriptions and images are accurate. However, images are for illustrative purposes only. Actual products may vary slightly in colour or packaging. All measurements and capacities provided are approximate.

4. Pricing and Payments

All prices are quoted in GBP and include VAT at the prevailing rate. We accept the following payment methods:

  • Shopify Payments (Credit/Debit cards)
  • PayPal
  • Klarna (subject to status and terms provided by Klarna)
  • Bank transfer payable by invoice

Payment must be cleared in full before any goods are dispatched.

5. Price Match Guarantee

We strive to offer the best value. If you find an identical product (same brand, model, and year of manufacture) available at a lower price from another UK-authorised retailer, we will endeavour to match it. The item must be in stock and available for immediate delivery. This guarantee excludes auction sites, clearance sales, and non-UK retailers. We reserve the right to verify the price and may decline a match if the price falls below our cost of acquisition.

6. Delivery

Delivery dates provided are estimates only and are not guaranteed. We use third-party courier services for all deliveries. Important: We strongly advise that you do not book independent installers, contractors, or fill your pool with water until you have received, inspected, and confirmed all parts are present and undamaged. MadFun Ltd is not liable for any third-party costs incurred due to delivery delays.

7. Returns, Cancellations and Refunds

We offer an extended 90-day return policy from the date of delivery, subject to the following conditions:

  • Unopened & Unassembled: Items must be returned in their original, unopened, and sealed packaging to be eligible for a full refund.
  • Opened Items: If a product has been opened, it must be repackaged exactly as it was received. All internal components, hardware, fixings, and manuals must be present.
  • Inspection: Every return is subject to a technical inspection. If our team finds any sign of assembly (such as indentations on poles, water marks on liners, or used filters) or if components are missing, the return will be rejected. In such cases, no refund will be issued, and the goods will be returned to you at your expense.

8. Faulty Goods (Consumer Rights Act 2015)

If your product is faulty, you have a 30-day "short-term right to reject" for a full refund. After 30 days, we will fulfill our statutory obligations to offer a repair or replacement.

Beyond the initial 6 months, the burden of proof regarding the fault shifts to the consumer as per UK law. This does not affect any additional manufacturer's warranties provided with the product.

9. Limitation of Liability

To the maximum extent permitted by law, MadFun Ltd shall not be liable for any indirect, special, or consequential damages. This includes, but is not limited to, the cost of water, chemical treatments, landscaping, or third-party installation fees. Our total liability is strictly limited to the purchase price of the product.

11. Governing Law

These terms are governed by the laws of England and Wales. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
